Terms Of Sale

1. Governing Law

This sale, and any dispute arising from it, shall be governed by the laws of the State of Utah, without regard to conflict of law principles.

2. Jurisdiction and Venue

All disputes, claims, or legal actions arising from this sale shall be resolved exclusively in the state or federal courts located in Salt Lake County, Utah. The buyer agrees to submit to the personal jurisdiction of these courts and waives any objection to venue.

3. Limitation of Liability

The seller’s liability for any claim relating to the product is limited to, at the seller’s option, either: (a) a refund of the purchase price, or (b) replacement of the product.

The seller shall not be liable for any indirect, incidental, consequential, or special damages, including but not limited to lost profits, lost time, inconvenience, or other costs beyond the purchase price.

4. Warranty Disclaimer

Unless otherwise stated in writing, products are sold “as-is” without any express or implied warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

5. Entire Agreement

These Terms of Sale constitute the entire agreement between buyer and seller regarding the transaction and supersede any prior communications or understandings.
